Last night Rapid city Council voted 9-1 to Oppose Powertech USA’s plan to begin Uranium mining operations near Edgemont and Fall river SD. ITU President Payu Harris made a Powerful presentation still on his “1868 is the law” platform and successfully demonstrated the fact that the 1868 Ft. Laramie treaty remains a valid legal document and showed that the proposed mining project falls well within the borders of Lakota country as per a legal and binding international Treaty document. Rapid city Attorney looked visibly concerned after “Treaties are the supreme law of the land” constitutional text was read into public record, President Harris then showcased a local legal case where a tribal member won a court case using the “Bad man clause”. This showcased the legal validity of the 1868 treaty and by referencing Article 16 which outlines ” and also stipulates and agrees that no white person or persons shall be permitted to settle upon or occupy any portion of the same; or without the consent of the Indians first had and obtained, to pass through the same;” The dozens of grassroots opposition cheered when the Resolution of Opposition was approved…ha ho it is a great day to be Indigenous.
